This research was conducted in the second half of 2010 after the Fair Work Act’s good faith bargaining provisions had been in force for more than 12 months.
What AREEA found was:
- Bargaining had become more difficult for employers under the
Fair Work Act;
- There were reduced agreement-making options under the Fair Work
Act for employers;
- The laws about protected industrial action during bargaining
needed amendment; and
- Employers should have the option of negotiating a greenfield
agreement free of union involvement.
